Terms of Use

These Terms of Use ("Agreement") have been entered into by and between GoWellFly and the User. In this Agreement, the User and GoWellFly shall each be referred to as a "Party" and jointly as the "Parties".

The User accepts and declares that, regardless of whether they benefit from the Services, by becoming a member of and/or accessing the Platform, they have read all of the terms and conditions set forth in this Agreement, fully understood the content and approved all of its provisions electronically.

This Agreement has been prepared in order to set forth, in particular, the terms and conditions to be complied with under any circumstance whether or not the Services are being provided when the Platform is being used, as well as to regulate matters not contained in other texts prepared for the use of the Platform with the Users.

1. Definitions

Within the scope of this Agreement;

Individual User means a person who, other than a Clinic and a Supplier, accesses the Platform and benefits from the Services,
Privacy Policy and Personal Data Notice means the text on the Platform, accepted by the Users, in which the manner and purpose of processing of the Users' data and the privacy policies of GoWellFly are detailed,
Services means any and all services offered by GoWellFly to the Users through the Platform within the scope of this Agreement,
Clinic means healthcare institutions registered on the Platform that are authorised to provide healthcare services within the scope of the relevant legislation,
Clinic Services means the healthcare services to be provided by the Clinics to the Users within the scope of the agreements they will conclude with the Individual Users and the relevant legislation,
User means, individually or jointly, the Individual User, the Clinic and the Supplier,
Platform means www.gowellfly.com, owned by GoWellFly, and/or its mobile application,
Supplier means the person who will sell Products or services to other Users via the Platform,
Products means the products or services offered by the Supplier to other Users via the Platform,

2. Subject and Scope

2.1. The subject of this Agreement is to determine the terms of use of the Platform, the conditions for benefiting from the Services offered on the Platform by GoWellFly, and the rights and obligations of the Parties.

2.2. In order for the User to benefit from the Services offered by GoWellFly by accessing the Platform, the User shall accept this Agreement. In the event of a breach of this Agreement, GoWellFly may prevent the User from accessing the Platform.

2.3. The Platform constitutes a whole together with all of its sub-components and domain names, and all of its services such as web, mobile, database, API, e-mail and the like are subject to the provisions of this Agreement.

3. Rights and Obligations of the Parties

3.1. The Platform has been established by GoWellFly with the purpose of facilitating communication between the Users in a digital environment. GoWellFly does not carry out any intermediary or advertising activity for any Clinic accessing/becoming a member of the Platform; it solely provides the technical infrastructure necessary for communication between Users. Any element on the Platform or any announcement, notification, correspondence or similar information that may be provided by GoWellFly to the Users within the scope of this Agreement may not be construed as Users being directed to a specific Clinic, or as recommending a specific Clinic Service, or as providing/causing to be provided healthcare services. The relationships established between Users via the Platform are entirely at the discretion of the Users, and GoWellFly does not provide any advice or guidance in this regard.

3.2. Users may benefit from the Services without becoming a member of the Platform, and may also become members by clicking the "Sign Up" button on the Platform and filling in the requested information on the screen that opens.

3.3. Clinics publish the information they wish other Users to access on the Platform by recording it on the Platform. Users may view this information and contact the Clinics. GoWellFly has no discretion regarding matters such as the scope and conditions of the Clinic Services, appointment dates and times, or fees.

3.4. The User may have an online consultation with the Clinic that they have selected and contacted via the Platform. Such consultation is for advisory purposes only and does not constitute any diagnosis or treatment.

3.5. Online consultations may be carried out via third-party infrastructures. GoWellFly cannot access the content of such consultations and is not responsible for them.

3.6. The Services offered on the Platform are not directly intended for diagnosis or treatment in any way. GoWellFly does not recommend any Clinic to any User. The Platform solely provides communication infrastructure.

3.7. The Supplier may offer products or services to other Users via the Platform. GoWellFly is not a party to such sales.

3.8. Any and all relationships between Users are outside the scope of this Agreement.

3.9. The User accepts that they shall act in accordance with all applicable legislation while using the Platform.

3.10. The User undertakes that they shall not use any software or content that may damage the Platform.

3.11. Only the User is responsible for the accuracy of the information provided by them.

3.12. The User accepts that they shall not engage in the following acts:

unlawful use
providing false or misleading information
using data belonging to others
manipulating the platform
spreading malicious software
infringement of intellectual property
breaching system security

3.13. GoWellFly is not responsible for technical issues and interruptions.

3.14. The User declares that the content uploaded to the Platform complies with the law.

3.15. The User declares that they are of legal age.

3.16. GoWellFly is not responsible for interruptions arising from technical infrastructure.

3.17. The User is responsible for their own account security.

4. Use of Artificial Intelligence

Artificial-intelligence-supported analyses, recommendations and guidance that may be offered within the scope of the Platform:

are for informational purposes only
do not constitute medical diagnosis or treatment
do not replace a doctor's opinion

The User accepts that the recommendations provided by artificial intelligence are not binding and are of a guiding nature only.

5. Privacy and Personal Data

GoWellFly processes User data in accordance with the relevant legislation.

The User is obliged to obtain the necessary permissions when sharing data belonging to third parties.

6. Intellectual Property Rights

All content on the Platform belongs to GoWellFly. It may not be used without permission.

7. Term and Termination of the Agreement

The Agreement is of indefinite duration. GoWellFly may terminate user access where it deems it necessary.

8. Other Provisions

The provisions on force majeure, notifications and the competent court shall apply.

The Istanbul Courts shall have jurisdiction over any disputes.

9. Commercial Electronic Messages

GoWellFly may send campaign and information messages to the user. The user may reject such communications at any time.
